How we collect, use, store and disclose your personal information.

1. Who we are
This Privacy Policy explains how Abalos Migration (“we”, “us”, “our”) handles personal information. We are an independent referral service based in New South Wales, Australia, serving clients Australia-wide.
Important: We are not registered migration agents or Australian legal practitioners, and we do not provide immigration assistance or legal advice. Our role is to connect you with an independent MARA-registered migration agent or Australian migration lawyer. Once you are referred, that professional handles your personal information under their own privacy policy.
We are committed to protecting your privacy and handling your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

2. Information we collect
We only collect personal information that is reasonably necessary for us to refer you to a suitable migration professional. Depending on your enquiry, this may include:
- your name, email address and phone number;
- your location (city and country);
- your nationality or country of citizenship;
- your current visa status and visa history;
- the type of visa or migration outcome you are seeking;
- general details about your circumstances, such as your occupation, qualifications, study plans, relationship or family situation; and
- any other information you choose to include in your enquiry to us.
You do not have to give us your personal information. However, if you choose not to, or if the information you give us is incomplete or inaccurate, we may not be able to match you with a suitable professional.
You may deal with us anonymously or under a pseudonym when making a general enquiry. This will not be practicable if you want us to make a referral on your behalf.
3. Sensitive information
Some of the information relevant to a migration matter is sensitive information under the Privacy Act — for example, information about your racial or ethnic origin, health, criminal record, or membership of a professional or political association.
We do not ask you to provide sensitive information, and we ask that you do not send us more detail than we need in order to refer you. Where you do provide sensitive information in your enquiry, you consent to us collecting it and disclosing it to the migration professional we refer you to, for the purpose of that referral. We will not use or disclose sensitive information for any other purpose without your consent, unless we are required or authorised to do so by law.
4. How we collect it
We usually collect personal information directly from you, when you:
- email us or use an email link on our website;
- call or send us a message by phone;
- contact us through social media or a third-party platform; or
- are referred to us by a third party, such as a migration professional or a person you know.
If we receive personal information about you that we did not ask for and do not need, we will destroy or de-identify it where it is lawful and reasonable to do so.
5. Why we collect it
We collect, hold and use your personal information to:
- understand your situation and what kind of professional you need;
- identify and match you with a MARA-registered migration agent or Australian migration lawyer in our network;
- introduce you to that professional and pass on your enquiry details;
- respond to your questions and follow up on your enquiry;
- keep records of referrals we have made, including for the purpose of any referral fee payable to us; and
- comply with our legal obligations.
6. Who we disclose it to
This is the most important disclosure in this policy, so we want to be clear about it.
When you ask us to refer you, we disclose your enquiry — including the personal information you have given us — to one or more independent migration professionals in our network. By asking us to refer you, you consent to that disclosure.
We may also disclose your personal information to:
- our service providers, such as our email and IT hosting providers, who help us operate our business;
- our professional advisers, such as our accountants or lawyers; and
- any person or body to whom we are required or authorised to disclose it by law.
We do not sell your personal information, and we do not disclose it to advertisers or data brokers.
Once we refer you, the professional you are referred to is a separate entity and is responsible for its own handling of your personal information. They will have their own privacy policy, and we encourage you to read it. We are not responsible for how they collect, use or disclose your information after the referral.
7. Referral fees
Our service is free to you. Where you engage a professional we have referred you to, we may receive a referral fee from that professional. This means we have a commercial interest in referrals proceeding. We disclose this so you can take it into account, and we encourage you to satisfy yourself independently that any professional you engage is suitable and properly registered.
8. Overseas disclosure
We use business email and IT services that may store data on servers located outside Australia, including in the United States and other countries where our providers operate data centres. Where we disclose personal information to an overseas recipient, we take reasonable steps to ensure it is handled consistently with the Australian Privacy Principles.
If you ask us to refer you to a professional located outside Australia, or you are located outside Australia, your information may be disclosed to recipients in those countries.
9. Storage and security
We take reasonable steps to protect your personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. These steps include restricting access to information to those who need it, using reputable service providers, and using password-protected and access-controlled systems.
No method of transmitting or storing information is completely secure. Email in particular is not a secure medium. While we take your privacy seriously, we cannot guarantee the security of information you send us over the internet.
10. How long we keep it
We keep your personal information only for as long as we need it for the purposes described in this policy, or for as long as we are required to keep it by law. When we no longer need it, we take reasonable steps to destroy it or de-identify it.
11. Direct marketing
We may occasionally contact you about our services where you would reasonably expect us to, and where we are permitted to do so under the Privacy Act and the Spam Act 2003 (Cth). You can opt out at any time by emailing info@abalosmigration.com.au or by using the unsubscribe function in any message we send. We will action your request promptly and at no cost to you.
12. Website data and cookies
Our website is a simple static website. It does not require you to create an account, and it does not include a submission form — enquiries are made by email or phone using the links provided.
Our website loads fonts from Google Fonts. When your browser requests those fonts, your IP address is disclosed to Google as part of that request. You can prevent this by blocking third-party resources in your browser.
Our web hosting provider may automatically record standard server log information, such as your IP address, browser type and the pages you visit, for security and operational purposes.
If we add analytics, advertising or tracking tools to our website in future, we will update this policy before doing so.
13. Access and correction
You have the right to ask for access to the personal information we hold about you, and to ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading.
To make a request, email us at info@abalosmigration.com.au. We may need to verify your identity before we act on your request. We will usually respond within 30 days. There is no fee for making a request, although we may charge a reasonable fee for giving access in some circumstances. If we refuse your request, we will tell you why in writing and explain how you can complain.
14. Complaints
If you believe we have breached the Australian Privacy Principles or otherwise mishandled your personal information, please tell us first so we can try to put it right.
Send your complaint in writing to info@abalosmigration.com.au, with enough detail for us to investigate. We will acknowledge your complaint and aim to respond within 30 days.

If your complaint is about the conduct of a registered migration agent we referred you to, you can also complain to the Office of the Migration Agents Registration Authority (OMARA) at mara.gov.au. If it is about a lawyer, you can complain to the legal services commissioner in that lawyer's state or territory.
15. Changes to this policy
We may update this Privacy Policy from time to time to reflect changes in our practices or the law. The current version will always be available on this page, with the date it was last updated shown at the top. We encourage you to review it periodically.
